General terms and conditions

1. Regarding the formalisation of the travel contract

Your trip reservation must be made in writing via email to your travel planner. Afterwards, a registration form containing the travellers’ information must be completed. The travel contract is concluded upon acceptance of the General Terms and Conditions and the payment of a 30% deposit of the total reservation amount. It is the traveller’s responsibility to verify that the documents provided match the services agreed upon in the contract. If this is not the case, please contact your travel planner to make the necessary adjustments.

2. Terms of payment

Confirmation of services will be provided after payment of 30% of the total amount of the reservation has been completed. The deposit must be paid to Bella Aventura within one week of receiving the booking confirmation. Payment is made via a payment link provided by the agency or by bank transfer. The remaining amount is due 45 days prior to arrival. A new payment link will be set up for this purpose. Without full payment of the total amount of the trip, Bella Aventura will cancel the services and apply the corresponding cancellation conditions.

3. Cancellation conditions

  • Up to 45 days before the arrival date, a cancellation fee of $200.00 per person will be charged to cover the administrative costs of travel planning.

  • Between 44 and 31 days before the arrival date, a cancellation fee of 50% of the total amount of the reservation will be charged.

  • Between 30 and 16 days before the arrival date, a cancellation fee of 75% of the total amount of the reservation will be charged.

  • 15 days or less before the arrival date, the total cost of the agreed services will be charged.

4. Included services

The services included in your trip are exclusively those listed in your travel confirmation. Any changes or adjustments must be requested in advance from your travel planner. These changes may incur additional costs.

5. Unused services

Bella Aventura is not obliged to request a refund if the customer decides not to use the services included in the travel package (such as hotel stays, activities, and/or transfers).

6. Termination of contract due to exceptional circumstances

If the trip is prevented, endangered, or significantly impaired by an event of force majeure that was not foreseeable at the time the contract was concluded (e.g., natural disasters, political unrest, pandemics, epidemics, crises), Bella Aventura may terminate the contract. In this case, Bella Aventura will refund the tour price minus a compensation fee of $150.00 per person for administrative costs.

7. Warranty / Obligation to cooperate

If a travel service is not provided in full in accordance with the contract, the customer may demand appropriate compensation within a reasonable period of time. Bella Aventura may remedy the situation by providing a replacement service of equal or higher value, provided this is reasonable for the customer and the travel defect was caused intentionally or the remedy does not constitute an impermissible change to the contract.

Bella Aventura may refuse to rectify the situation if the remedy requires disproportionate effort. If the travel services have not been provided in accordance with the contract, you must assert your claims against Bella Aventura during your stay in the country. If defects or complaints are not reported during the trip by telephone (+506 2236 5226 main phone number or +506 8439 4040 emergency number) or by email to the travel planner, Bella Aventura is exempt from any kind of complaint or refund request.

8. Limitation of liability

Bella Aventura acts as an agent and coordinator for services provided by third-party providers (accommodation, land, water, and air transportation, independent tour guides, and organisers of all kinds of activities). We are responsible for carefully selecting these providers, particularly with regard to their suitability, compliance with applicable regulations and laws, and insurance coverage. Bella Aventura is therefore not liable for the agency services of these third-party companies, unless we can be accused of intent or gross negligence in their selection. In particular, liability is excluded for personal injury or death, as well as property damage and financial loss due to force majeure, civil unrest, or natural disasters. Bella Aventura recommends that you take out travel accident and luggage insurance.

8.1 Bella Aventura has no influence on the allocation of specific rooms and cannot guarantee them. This is determined by the needs and use of space of the contracted service provider.

8.2 Bella Aventura cannot guarantee how many people will participate in each activity. The activity will be carried out by subcontracted service providers.

8.3 Bella Aventura cannot be held responsible for delays on the roads due to landslides, protests, and other circumstances beyond the agency’s control.

8.4 Bella Aventura does not offer refunds due to delays on international flights. However, it will make the necessary changes to ensure continuity of service in the event of such an unforeseen circumstance.

8.5 Bella Aventura cannot guarantee that the contractually agreed activities will be offered in languages other than Spanish and/or English, unless the trip has been arranged with a private tour guide in another specific language.

8.6 Bella Aventura offers certain services that are part of a package (Tortuguero, Corcovado, Pacuare, etc.) with various activities. The agency provides the itinerary for the activities but cannot guarantee the order in which they will take place.

8.7 Bella Aventura cannot accept any responsibility if the customer is unable to meet the essential requirements (a valid driver’s licence and credit card) for car rental.

8.8 Bella Aventura has no control over weather-related inconveniences. Costa Rica is a tropical country with varying microclimates.

8.9 Bella Aventura is unable to guarantee wildlife sightings, as it is impossible to control the behaviour of animals in their natural habitat.
